Protecting Plaintiff - Injury Victim Interests During Settlement
If you are a plaintiff and/or injury victim,
this page may be the most important page you see this year.
As you may have already discovered, during the settlement process, the defense attempts to use their power to dictate YOUR settlement so they can make sure the settlement is structured in THEIR best interest.
Casualty Companies and large self-insured corporations and hospitals want to profit off of you as they are “going out the door” after settlement of your claim.
Of course, there is a major problem with this.
YOUR NEEDS and interests, as the Plaintiff or injury victim, are not being fully addressed… leaving you with a settlement that may not directly address your financial needs after the settlement including:
- Ongoing medical costs (often for a lifetime of treatment)
- Loss of income
Protect Your Interests - Reach Your Goals
You can ensure YOUR INTERESTS are protected during the financial aspects of the settlement by insisting that your attorney work with a qualified Plaintiff-Loyal Settlement Planner.
During settlement, the defense brings in their own settlement expert to assist in protecting their financial interests during the settlement.
Do you want to rely on THEIR EXPERT to provide you
with the best possible solution to your needs?
Of course not…
We work with your attorney to ensure that your interests are protected and to educate you ALL OF YOUR OPTIONS… not just the options the defense presents to you.
Why Work With A Settlement Planner?
There are many reasons why every Plaintiff or injury claimant should work with a qualified Plaintiff-Loyal Settlement Planner. Here are a few of the reasons:
- We work with your attorney to place the power back into your hands during the settlement
- The defense hires their own Structured Settlement broker who acts in the best interest of the DEFENSE… not YOURS. You should have your own expert to look out for YOUR best interests
- Your attorney is likely not qualified to advise you on the financial aspects of the settlement; opening them up to increased liability, and you ????
- We charge you no fees for our expert settlement planning services
- Structured Settlements ARE NOT RIGHT FOR EVERYONE! We as settlement planners, will educate you on ALL of your options, so you can make a well informed decision as to what is best for YOU… not what is best for the defense
- We work ONLY for plaintiff’s and injury victims every day, so we know the roadblocks during the settlement and how to effectively navigate them to place you in the best possible position after settlement
In essence, we bring the power back to you and make sure the defense does not abuse their position and place you in an unfavorable situation after settlement.

What is the Settlement Planning Process?
The Settlement Planning process is a comprehensive approach designed to ensure that the settlement meets YOUR needs, and no one else. By fully advising you on ALL of your financial options, and shifting the control of the settlement away from the defense, this process ensures that your short and long-term needs are met with the most effective settlement plan possible.
Below is a brief overview of our Settlement Planning process.
- Prior to mediation: (30,60, 90 days) You receive a Letter of Introduction explaining who we are, our qualifications, and what we do.
- Prior to, or at, mediation: Our team assists the Plaintiff Attorney on intelligence and negotiation tactics of the defendants, while engaging you in concept discussion of settlement planning.
- Time of Settlement: If the defense has their own Structured Settlement broker, we will seek disclosures from them regarding rebates or kickbacks to the casualty insurer or any existence of approved annuity lists that may limit YOUR freedom of choice.
- After disclosure to you and your attorney, we obtain authority from you as to how you wish to proceed.
- The case is settled without committing you to any 1 (one) strategy.
- Post-Settlement: We meet with you for in-depth planning designed to educate you and to assist in making decisions that have YOUR best interests in mind, an no one else.
- Delivery of Settlement Plan: We provide you with your custom Settlement Plan and information on our recommendation based on YOUR goals and needs.
- Full Market Survey - If Structured Settlement annuities are deemed to be appropriate to meet your future needs, we obtain bids from EVERY COMPANY IN THE MARKETPLACE in a full market survey, so all prices and financial ratings are fully disclosed to you.
- Execution of the Settlement Agreement: The settlement agreement is executed with the defense, which may or may not include structured settlement annuities, as per consensus of you and ALL of your advisors.
- Annual review as necessary
The entire settlement planning process is designed to place the power back in your hands and to craft a settlement that truly helps you address your short and long-term needs and goals.
